Genesis Group was engaged to render a planning opinion as to the legally permissible and physically possible uses on the subject properties. Genesis reviewed the Future Land Use categories and zoning districts on the subject properties as well as the relationship between the Future Land Use, zoning, and jurisdictional wetland areas. Genesis evaluated the development potential of the subject properties, as well as determined the highest and best use of the subject properties pre and post suit.
The planning testimony of Genesis Group ncluded an opinion on the highest and best use of the subject properties as it relates to the legally permissible and physically possible aspects of development. This opinion will include consideration of the jurisdictional wetland areas on the property over time, and the impact of these wetland areas on the pre and post suit development of the property.
The subject properties contain approximately 120 acres of land. The properties are located in both unincorporated Brevard County and the incorporated area of the City of Titusville. All of the properties involved are currently vacant, undeveloped land. I-95 runs in a north-south direction through the subject area. I-95 is a limited access facility and does not provide direct access to any of the subject properties. Access to the subject properties is available from SR 50 north to the parcels west of I-95, and primarily from SR 405 and Foley Street to the parcels lying east of I-95.
